Work For Hire Agreement

Work For Hire Agreement

Jurisdiction:

Area of Law:

If you are going to pay someone to create something for you, it's important to have him or her sign a Work Made For Hire Agreement. If you don't, then the copyright is owned by the work's creator and you just take a license.  Also, if you ask for the agreement to be signed after the work has been created, it will most likely end up costing you because no one wants to sign a Work Made for Hire Agreement after the work has been completed and paid for.  Moreover, you can only file a copyright if you own the work, so if you don't have this agreement signed, then you don't own the work. Consequently, if you can't file a copyright, then you can't enforce your rights.
