After you receive a judgment

After you receive a judgment in your favor, you may have some difficulty collecting on the judgement. Many debtors will not voluntarily pay their judgements, forcing you to take steps to receive the money you are owed. In Utah, there are a variety of methods for you to try to in order to collect your judgment.
For example, you can have the debtor’s property seized and sold to raise funds to repay your debts. Also, you can file your civil judgement with the County Recorder’s office in the county where the debtor owns property to have a judgement lien filed against the debtor’s real property. A judgment lien prevents the debtor from mortgaging or selling real property until the lien is satisfied and can negatively affect the debtor’s credit. In addition, you may be able to obtain a Writ of Garnishment. A Writ of Garnishment allows an employer to take funds from the debtor’s paycheck to satisfy a judgement. It may be a good idea to try a combination of these methods to be successful.
